Professional and Immigration Business Plans for the EB-2 NIW: Choosing the Right Approach to Describe Your Proposed Endeavor

ProfVal

SUMMARY:

  • When applying for an EB-2 NIW, the USCIS may request a "detailed description of their proposed endeavor"

  • This article highlights two approved petitions, one with an endeavor described with a Professional Plan and the other with an Immigration Business Plan.

  • It is important for a petitioner to have legal representation. An Immigration Business Plan or a Professional Plan can support the work of capable immigration attorneys.

Business or Professional Plan?
The choice between an EB-2 NIW Business Plan or Professional Plan is based on the goals of your proposed endeavor

FULL ARTICLE:

The USCIS will often request a "detailed description of the proposed endeavor," meaning the petitioner must clearly explain their intended work in alignment with EB-2 NIW requirements (USCIS). Thus, the way a petitioner describes their proposed endeavor can be a critical factor to the potential success of their petition.

In describing one's proposed endeavor, one might use a personal plan or personal statement, a Professional Plan , or an Immigration Business Plan.  This post highlights two individuals whose EB-2 NIW petitions were approved in 2025.

One petitioner added a Professional Plan to their petition.  The other shared their Immigration Business Plan, a document produced in collaboration with GuidedVenture.com.

The two petitioners had some key attributes in common.

Similarities Between the Petitioners:

  1. Each worked with experienced immigration attorneys—one was a client of Rosas Law Group (rosaslawgroup.com) and the other received legal guidance from Nossa Law Firm (nossalaw.com).

  2. Both Petitioners demonstrated exceptional ability, holding advanced degrees, over a decade of experience, industry certifications, and recognition from peers.

  3. Their proposed endeavors had the potential for significant implications for U.S. national security, but required a clear plan articulating the benefits resulting from their endeavor in order to align with EB-2 National Interest Waiver (NIW) criteria (learn more about NIW requirements)

NIW Eligibility Requirements

To qualify for an EB-2 NIW, a petitioner’s endeavor must meet the Matter of Dhanasar criteria, frequently called the Dhanasar Prongs.

  • Substantial Merit & National Importance – The endeavor must significantly benefit the U.S..

  • Well-Positioned to Succeed – The petitioner must showcase relevant expertise, credentials, and a high potential to succeed in their proposed endeavor.

  • National Interest Waiver (NIW) Justification – The U.S. must benefit from waiving the job offer and labor certification requirements.  Of the three requirements, this is the most challenging to meet, as a petitioner can demonstrate the other two without demonstrating that the U.S. will receive benefits sufficient to waive the PERM process.

Professional Plans vs. Immigration Business Plans

The choice of a Professional or Immigration Business Plan depends primarily on whether the petitioner aims to work independently or establish a business.

  • Professional Plans: Designed for individuals seeking employment, freelancing, or research roles, focusing on their skills and experience.

  • Business Plans: Tailored for those launching a business, hiring employees, and projecting financial growth, emphasizing market viability and operations.

Now, let’s examine two real cases and how a Professional or Immigration Business Plan can support the work of an immigration attorney.

A Security Specialist’s Professional Plan

A client of Nossa Law, a security specialist, aimed to work in the U.S. as a Security Specialist Consultant in the Defense and Security sector. With over a decade of experience, they plan to provide consulting services to businesses, government entities, and private sector organizations, thus countering disinformation and misinformation operations.

We assisted in developing their Professional Plan, a 30-page single spaced-document, to articulate the direct beneficiaries of their work and how it enhances national security, economic stability, and democratic resilience. Additionally, an independent EB-2 NIW Expert Opinion Letter evaluated their expertise in hybrid warfare and geopolitical risk, noting their ability to strengthen both public and private sector resilience against emerging threats. All experts are asked to provide authentic and true evaluations, which we believe contributes to the credibility of our Expert Opinion Letters.

The petition was submitted in late 2024 and approved in January 2025.

A Customs Compliance Specialist’s Immigration Business Plan

A client of Rosas Law Group, Flavia (not her real name), is a skilled customs compliance specialist with over a decade of experience in manufacturing. She holds an MBA, specialized licensures, and industry certifications, providing a strong foundation of qualifications aligned with EB-2 qualification criteria.

She proposed establishing a business that offers customs compliance consulting to companies involved in international trade, including manufacturers, importers, and exporters and conducts workshops on global trade laws. Her Immigration Business Plan, developed in collaboration with GuidedVenture.com., emphasized her business’s role in national security, economic growth, and indirect employment in adjacent industries.

In addition to supporting her attorneys’ legal arguments, her Immigration Business Plan provided a strategic framework for her business success.

Her visa was approved in January 2025.

Final Summary

The choice of whether to develop a Professional Plan or Immigration Business Plan should be based on a professional's specific goals. For those who do not intend to start a new business, a Professional Plan is typically appropriate.  Professionals who intend to launch a business may find that articulating their vision via an Immigration Business Plan is an effective way of describing their intended endeavor.

This decision should be based on a petitioner's goals, along with their attorney's advice -- working with a capable immigration attorney is one of the most important steps a professional can take in order to begin their petition process.

ProfVal offers Professional Plans and Immigration Business Plans (jointly produced by GuidedVenture.com) to support attorneys and their talented clients across a variety of visa categories including the E-2, EB-1, EB-2 NIW, and L-1.

We also support attorneys and their clients by providing Expert Opinion Letters, RIMS II assessments, and other essential documentation.
